Definitions

References to “we”, “us”, “our”, “Seller”, or “Website Owner” refer to MDC Water Pty Ltd.
References to “you”, “your”, “buyer”, “customer”, or “user” refer to any person accessing our website for the purposes of browsing or purchasing products.

1. Product Prices

  • All prices displayed on this website are in Australian Dollars (AUD) and include Goods and Services Tax (GST) at the applicable rate unless otherwise specified.

  • Prices also include standard shipping costs within Australia, except where explicitly stated otherwise on a product listing.

  • Prices, promotions, and product availability are subject to change without notice. We reserve the right to update prices at any time, even after an order is placed (in cases of pricing errors).

  • If a product is mistakenly listed at an incorrect price, we reserve the right to cancel or refuse any orders placed at that price, in accordance with applicable consumer protection laws.

2. Taxes and Duties

  • You are responsible for the payment of any taxes, duties, levies, or other charges imposed by government authorities outside of GST.

  • This includes, without limitation, customs duties and other charges that may apply if goods are shipped internationally.

3. Delivery

  • We offer free shipping within Australia unless delivery is to a remote area, in which case additional charges may apply.

  • Customers in remote, regional, or roadside locations may be required to collect their parcels from a post office, POP, or collection point.

  • Orders are dispatched via reputable Australian couriers. Delivery addresses must be accessible during normal business hours (Monday–Friday).

  • Estimated delivery times are 3 to 14 business days from payment. Delivery timelines are indicative only and may vary due to factors beyond our control.

  • We aim to dispatch orders within 1 business day of purchase but are not liable for delays.

  • Delivery is deemed complete when goods reach the address you provide. You are responsible for ensuring someone is available to accept delivery.

  • Note: We do not offer free shipping to the following territories: Norfolk Island (2899), Christmas Island (6798), and King Island (7256).

4. Returns and Refunds

(a) Transit Damage

  • We carry transit insurance. You must inspect goods on delivery and notify us of any damage within 48 hours to preserve eligibility under the insurance.

(b) Faulty Goods

  • If goods are defective or not as described, you must notify us in writing within 7 days of delivery.

  • Evidence of the defect may be requested. We will inspect the goods and may offer a repair, replacement, or refund, in accordance with Australian Consumer Law.

(c) Incorrect Goods Delivered

  • Report any delivery errors within 2 days. We will arrange collection and redelivery at our cost.

(d) Goods Damaged by Customer

  • Returns will not be accepted for items damaged due to misuse, improper installation, wear and tear, or mishandling.

(e) Return Condition

  • Returned items must be in their original packaging, unused, and accompanied by all included materials and documentation.

(f) Refund Process

  • Refunds will be processed via electronic funds transfer or another agreed method.

  • For returns that are not due to a fault on our part, the original shipping cost and payment processing fees (e.g. PayPal or credit card fees) will be deducted from the refund.

5. 14-Day Change of Mind Guarantee

We offer a 14-Day Money Back Guarantee for change-of-mind returns under the following conditions:

  1. You notify us within 14 days of delivery.

  2. Items must be unused, in original condition, with all packaging and accessories.

  3. Products must be returned to us within 10 business days of return approval.

  4. Return shipping is at your cost, and goods remain your responsibility during transit.

  5. Refunds or store credit will be issued promptly after we receive and inspect the returned item.

  6. The original shipping cost and payment processing fees will be deducted from the refund total.

6. Warranty

We warrant that products supplied by us will be free from defects in workmanship for a period of 12 months from the date of delivery, unless otherwise stated.

The warranty does not cover:

  • Damage resulting from misuse, negligence, modification, or improper installation.

  • Normal wear and tear.

  • Damage caused by acts beyond our control (e.g., natural disasters, power surges).

  • Goods serviced or altered by unauthorised personnel.

  • Non-observance of instructions provided by us.

Where applicable, you will receive a repair, replacement, or refund in accordance with your rights under Australian Consumer Law.

7. Limitation of Liability

Our liability is limited, to the extent permitted by law, to one or more of the following:

  • The replacement or repair of goods;

  • The supply of equivalent goods; or

  • The refund of the purchase price.

We do not exclude or limit statutory guarantees under the Australian Consumer Law.

8. Privacy Policy

We respect your privacy. Personal data is handled in accordance with our Privacy Policy and applicable data protection laws.

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of that jurisdiction.
